General overview

Barrister Muamba Mukengeshayi Popol is a lawyer registered with the Kinshasa/Matete Bar, Mining and Quarrying Agent and Intellectual Property Agent in the Democratic Republic of Congo (DRC), and founder of the law firm Muamba Mukengeshayi & Associates, SCP law firm (“MM&A”).

In his professional practice, he advises, represents, and assists national and international clients, both public and private, in projects in the natural resources and infrastructure sectors and in certain branches of the investment, trade and industry sectors in the Democratic Republic of Congo, Republic of Congo and other OHADA member states. He also assists and advises financial institutions and investors in the implementation of projects in the OHADA area, in particular for the creation of companies, their various operations and dissolutions, as well as the creation of securities. 

Specialized in project finance, with a predilection for infrastructure projects in the oil, gas, and mining industries, he comes with extensive experience in assisting major international companies in acquiring participating interests (partnership agreements) in production sharing contracts, or in drafting and negotiating concession agreements. He also assists candidates for the award of titles and/or new contracts in the context of calls for bids and the setting up of joint ventures for the operation of mining concessions, and the drafting and negotiation of exploration and exploitation agreements that generally accompany the granting of mining titles. He has proven experience in project financing (including PPP, BOT and concession) in the energy (hydroelectric, renewable, photovoltaic, etc.) and infrastructure sectors, notably transport (airports, freeways, bridges, etc.), where he acts on behalf of governments, developers or lenders.

He has an excellent litigation and arbitration track record. He has represented several clients in complex proceedings before the Cassation Court (litigation, jurisdictional referral), the State Council, the Courts of Appeal, the civil, commercial, and labor courts in the DRC, as well as before the arbitral tribunals of the Common Court of Justice and Arbitration (CCJA), the International Chamber of Commerce (ICC) and the International Centre for Settlement of Investment Disputes (ICSID). 

Before setting up his own firm, Barrister Muamba Mukengeshayi Popol also had practical experience of international law practice, having worked for several years as a partner in the law firm Emery Mukendi Wafwana & Associates, founded by Barrister Emery Mukendi Wafwana, during which time he acquired solid expertise in assisting clients with complex, strategic and high-stakes cases.

Barrister Muamba Mukengeshayi Popol holds an LLB (a five-year university degree) in economic and social law from the University of Kinshasa. He has taken part in several specialized training courses around the world. He has published several scientific studies in specialized journals and other websites.

He is a member of numerous professional associations and organizations (International Bar Association (IBA), International Court of Arbitration of the International Chamber of Arbitration (ICC), American Bar Association (ABA), Union Internationale des Avocats (UIA), Conférence Internationale des Barreaux de Tradition Juridique Commune (CIB), International Law Firm (ILF).

Alongside his consultancy work, he is founder of the Juri-Afrique African legal database (www.Juri-Afrique.com), a website specializing in the research, writing and publication of African legal news. He is fluent in French and English.
